These Terms & Conditions (“T&C”) govern your use of the Prettied website and the purchase of products (“Products”). By placing an order or using our website, you agree to these T&C.
1. Parties and Acceptance
1.1 These T&C govern your use of the website and purchase of Products via Prettied, owned by Cerys Lewis Enterprises Limited (hereafter “we”, “us”, “our”, “Prettied”).
1.2 By placing an order or using the website, you confirm that:
- You accept these T&C in full, forming a binding contract,
- You have legal capacity to enter into a contract.
2. Definitions
- Customer / You: anyone ordering Products for personal or household use.
- Products: clothing, accessories, or other items sold via Prettied.
- Order: your request to purchase Products via the website.
- Delivery Address: the address you provide for shipping.
3. Prices and Payment
3.1 All prices are shown in New Zealand Dollars (NZD) as the base currency and include applicable taxes (e.g., GST) unless otherwise stated. For international customers, Shopify may automatically convert prices to the local currency at checkout. Any taxes, duties, or import fees applicable in your country are the responsibility of the customer unless otherwise stated.
3.2 We reserve the right to correct pricing errors. If an error occurs, we will notify you before dispatch and allow you to confirm or cancel your Order.
3.3 Payment must be made at the time of Order via the payment methods offered on our website.
4. Description of Products
4.1 We take reasonable care to ensure Product descriptions, images, measurements, and other details are accurate.
4.2 For clothing, we comply with all applicable consumer-information standards, including country-of-origin labelling, fibre content, and care labelling where required.
4.3 Minor variations in colour, size, or design may occur and are not considered faults.
5. Orders, Availability & Delivery
5.1 Orders are subject to availability. If a Product is unavailable after you place an Order, we will notify you and refund you in full.
5.2 Delivery fees, estimated delivery times, and any customs/import duties will be clearly shown at checkout.
5.3 Delivery timeframes:
- NZ: Estimated 9 Business Days.
- Australia: Estimated 8 Business Days.
- USA: Standard: Estimated 13 Business Days;
Express: Estimated 8 Business Days. - UK: Standard: Estimated 10 Business Days;
Express: Estimated 4 Business Days. - Canada: Standard: Estimated 10 Business Days;
Express: Estimated 7 Business Days. - Europe: Standard: Estimated 10 Business Days;
Express: Estimated 6 Business Days. - Asia: Standard: Estimated 4 Business Days.
5.4 Risk of loss or damage passes to the Customer upon delivery.
5.5 We are not responsible for delays caused by customs, courier issues, or circumstances beyond our control.
6. Returns, Exchanges & Refunds
6.1 Unless required by law, we are not obliged to accept returns for change-of-mind. If we do, Products must:
- Be returned within 14 days,
- Be unworn, unwashed, and with all tags attached,
- Be packaged securely.
6.2 Faulty or damaged Products: Contact us immediately at admin@clelimited.com with photos of the defect. We may request the return of the Product before issuing a replacement or refund.
6.3 Refunds: Once we receive the returned item, we will process refunds within 5–10 business days.
6.4 Return shipping costs are your responsibility unless the Product is faulty or we sent the wrong item.
6.5 We reserve the right to refuse returns that do not meet the above conditions.
7. Consumer Guarantees
7.1 Products are covered by consumer guarantees under the Consumer Guarantees Act 1993 (NZ) and similar consumer protection laws in the countries we ship to.
7.2 We do not limit statutory rights provided by local consumer laws in any country.
8. Intellectual Property, Copyright & Trademarks
8.1 The Prettied website is operated using Shopify, a third-party ecommerce platform. All website content, including product images, photographs, graphics, text, designs, and other media (“Content”), is owned by Cerys Lewis Enterprises Limited and protected under copyright and other intellectual property laws.
8.2 The name “Prettied” and the Prettied logo are registered trademarks owned by Cerys Lewis Enterprises Limited.
8.3 You may not copy, reproduce, distribute, display, or create derivative works from the Content without our express written permission. This includes, but is not limited to, use on social media, other websites, or commercial products.
8.4 You may use Content for personal, non-commercial purposes only, if expressly permitted by us. Any unauthorized use may result in legal action.
8.5 Shopify’s software, platform, and tools remain the property of Shopify and are used under license. Your rights to access and use the website do not grant ownership of Shopify’s technology.
9. Consumer Information, Transparency & Fairness
9.1 We will not mislead or deceive consumers and comply with all applicable consumer protection laws in NZ, AUS, USA, UK, and Canada.
9.2 All material terms — pricing, delivery, and fees — are clearly presented before checkout.
9.3 We treat all customers fairly, regardless of gender, race, religion, disability, or other protected attributes.
10. Privacy & Personal Information
10.1 We collect personal information to process orders and improve your experience.
10.2 Data is stored securely and handled in accordance with global privacy and data-protection laws.
10.3 Personal information may be shared with delivery providers or payment processors only as necessary to fulfill your Order.
10.4 You may request access or correction of your personal information at any time via admin@clelimited.com.
11. Limitation of Liability
11.1 To the extent permitted by law, Prettied is not liable for indirect, special, or consequential losses.
11.2 Our maximum liability for any claim is limited to the purchase price of the Product involved.
11.3 We are not responsible for delays or losses due to customs, shipping carriers, or circumstances outside our control.
12. Changes to Terms & Conditions
12.1 We may update these T&Cs at any time by posting them on the website.
12.2 Continued use of the website or placing an Order after changes constitutes acceptance.
13. Governing Law & Dispute Resolution
13.1 These T&Cs are governed by New Zealand law.
13.2 For international customers, your statutory rights under local consumer protection laws remain valid.
13.3 Any disputes will be referred to the relevant courts or tribunals in New Zealand.
